CANCELLATION POLICY:  EFFECTIVE 5/1/2020

NEW RESERVATIONS BOOKED AND/OR CONFIRMED WITH A DEPOSIT OR FINAL RENTAL PAYMENT AFTER 5/1/2020 WITH KNOWLEDGE OF THE COVID-19 VIRUS, POTENTIAL TRAVEL LIMITATIONS, POTENTIAL LIMITED RESOURCES, AND POTENTIAL LIMITED ACCESS TO AMENITIES  WILL ADHERE TO THE FOLLOWING CANCELLATION POLICY. 

**The only exception will be if rentals are banned on Seabrook Island, SC.**  If rentals on Seabrook Island are banned you may reschedule your vacation or accept a gift certificate for a future stay.  Rescheduled stays must be completed within 12 months of the original date of arrival.  Gift certificate funds are valid for use up to 12 months from the date of issue. 

VILLAS, COTTAGES- Reservations canceled 30 days or more prior to arrival date for 1-week rental; 60 days or more for a 2-week rental will receive a refund of the booking deposit – less the 5% registration charge; less than the above stated applicable notice will result in forfeiture of all monies paid.

PRIVATE HOMES-Reservations canceled 60 days or more prior to arrival date for 1-week rental; 90 days or more for a 2-week rental, will receive a refund of the booking deposit less the 5% registration charge. Less than the above stated applicable notice will result in forfeiture of all monies paid.  MONTHLY RENTALS: Deposit is non-refundable upon cancellation.  TRAVEL INSURANCE PREMIUMS are non-refundable per Red Sky Travel.  Review their terms carefully at the time of purchase.

PLEASE REVIEW TRAVEL INSURANCE COVERAGE OPTIONS IN DETAIL.  TRAVEL INSURANCE PREMIUM IS NON REFUNDABLE. NO REFUND OF BOOKING FEES WILL BE OFFERED INSIDE CANCELLATION DATES.

 Terms and Conditions

·     YOU AGREE to rent the property described in the RENTAL CONTRACT for the dates and rate specified.
·     Your reservation is not confirmed until we receive a signed rental agreement and your rental deposit payment.   DEPOSITS must be paid by valid credit card.  NO checks will be accepted for deposits.
·     YOU AGREE to the payment and cancellation policies as detailed on the DEPOSIT REQUEST form and at the end of this guest agreement.
·     YOU AGREE that the number of guests occupying the property is accurately reflected in your completion of the DEPOSIT REQUEST form.   AGENT has the prerogative to terminate this agreement and ask guests to vacate without reimbursement if more than the stated number of guests occupy the dwelling.
NO house parties, special events, wedding parties, or receptions may be hosted at this property. Guests found in violation of this agreement forfeits security deposit and will be responsible for any additional restoration charges.
·     ALL accommodations are privately owned.  Properties are furnished and equipped by the Owner. Neither Seabrook Exclusives INC nor the Owner will be responsible for providing additional furnishings or equipment, not on the premises.  Certain areas in each property are locked for the Owner’s use and are NOT available to guests. This includes but is not limited to outdoor umbrellas, grills, beach equipment, and bedding.
·     YOU AGREE and understand that check-in is not earlier than 4:00 PM on your scheduled arrival date.  Check-out is no later than 10:00 AM on your scheduled departure date.  YOU AGREE your credit card will be charged at a rate not less than $150.00 per hour for unauthorized occupancy.  ANY/ALL requests for early occupancy or late departure MUST BE APPROVED  by Seabrook Exclusives, INC property management in advance of your arrival date or 3 days prior to the scheduled departure date.  IF YOUR PROPERTY becomes available early we will notify you.
·     YOU AGREE NOT TO BRING A PET UNLESS HOME IS DESIGNATED AS PET FRIENDLY. YOU AGREE that if found in violation of this regulation you will be asked to leave, forfeiting any remaining rental nights.
·     YOU AGREE your credit card on file will be charged for any and all exterminating and clean up fees incurred in addition to the total rental.  Guests bring a dog will be charged PET FEES  for pet-friendly properties.  The pet fee is determined by the size, breed, and number of dogs.  MOST rental units only permit one dog.  Certain breed restrictions apply based on the individual unit rules.  ALL dogs must be explicitly approved by Seabrook Exclusives INC.
·     YOU AGREE that your pet will NOT be permitted on any bedding or furnishings.  Pet hair can be very difficult to remove.  If bedding or furniture requires special cleaning after your departure YOU AGREE your credit card on file will be charged.  This is not a part of the pet fee.
·     YOU AGREE if any special cleaning is required after your stay Seabrook Exclusives will charge your credit card on file.  This includes but is not limited to excessive sand, excessive pet hair, food or drink stains and spills on furniture or carpeting; trash not removed from the home and properly bagged in outside receptacles; refrigerator not emptied and properly bagged and disposed of in outside receptacles.
·     YOU AGREE at the end of your stay you will wash all dishes and return to their proper location; empty the refrigerator; properly bag and remove all trash to proper exterior receptacles; vacuum excess sand and pet hair.
·     SMOKING is not permitted inside any property offered by Seabrook Exclusives.  YOU AGREE that evidence of smoking constitutes an event of default.  If you or any of your guests are found to be smoking inside a unit you will be asked to vacate the property immediately, forfeiting any remaining rental nights.  YOU AGREE your credit card will be charged a minimum of $250.00 if the property smells like smoke.  Additional charges may apply if further action is necessary to mitigate damage from smoking.
·     GUEST is responsible for any and all damages to the premises caused by carelessness or negligence.  YOU AGREE your credit card will be charged for such damages.  An invoice detailing charges will be emailed to you.  Regardless of who caused the damage, you are the responsible party on file.  This includes but is not limited to charges for broken items, damage to furnishings, flooring, walls or bath fixtures; additional cleaning, smoking, and stains deemed beyond normal wear.
·     GUEST is responsible for key return.  YOU AGREE there will be a minimum $75 charge billed to your credit card on file for each lost key.
·     GUEST, on behalf of himself/herself, will hold Seabrook Exclusives harmless from any accident or injury whatsoever that may occur on the premises during occupancy.  While children are welcome in these units they are not child proofed.  YOU AGREE to absolve Seabrook Exclusives INC and employees of Seabrook Exclusives, INC of any damages related to an injury.  You are responsible for supervising any children you allow on the property at all times.

Limitations of Remedies, Damages, and Hold Harmless Agreement.  Guest agrees to indemnify and hold harmless Agent and Owner from and against any liability for personal injury or property damage sustained by any person, including, but not limited to, Guest, members of Guest’s party, and guests of Guest, resulting from any cause whatsoever arising out of or in connection with your stay at the Property.

·     GUEST agrees that Agent(s) may enter accommodations for necessary maintenance and/or repair and/or re-stocking of unit cleaning supplies during normal business hours. NO entry will occur without coordination with guests.  All staff will wear protective face coverings and gloves when appropriate.
·     AGENT is not responsible for appliances or air conditioning/heat breakdown.  Any breakdown will be repaired or replaced as quickly as possible.  Seabrook Exclusives, INC cannot accept responsibility for untimely construction or amenity closings on the Island.  YOU AGREE no refund will be issued for construction occurring at an adjacent property or another unnamed area.·
HIGH-SPEED INTERNET may be available at your unit.   Internet service is provided as a guest convenience but is not an explicit amenity of the property.  The service and equipment for the internet is provided by an outside vendor, not Seabrook Exclusives, INC.  If you plan to access the internet your equipment will need to be compatible and up to date in order to access this service.  Seabrook Exclusives, INC cannot ensure your equipment is compatible and properly configured.  Seabrook Exclusives has no control over the service provided by these outside vendors.  No refunds will be issued due to internet connectivity problems.
·     YOU AGREE NOT to tamper with equipment by changing any account information or passwords.  Charges will be levied to restore accounts to correct settings.
·   Guest understands and agrees that should the Property become unavailable, unfit, or uninhabitable due to reasons beyond the control of Agent, including but not limited to fire, weather events, acts of God, coronavirus, COVID19, viral outbreak, disease, evacuations, construction, government mandates, laws, or orders prohibiting or limiting short term rentals, or any other reason whatsoever beyond the control of Agent that causes the Property to become unavailable, unfit, or uninhabitable, this Agreement will be terminated without any liability on behalf of Agent or Owner, and Guest’s sole remedy for such termination will be, at Guest’s option: (1) moving the reservation to another date; (2) substitute accommodations, if available, at the published rental rate, or (3) credit toward a future stay to be used within one year.  Guest understands and agrees that in no event shall Agent or Owner be liable for any indirect, incidental, consequential, special or other damages as a result of such termination. Guest further agrees that they will have no further rights or remedies against Agent or Owner in the event Agent cancels or terminates the reservation pursuant to this paragraph.
·     PARKING is only permitted in designated areas.  Vehicles must be parked completely on concrete or asphalt.  YOU AGREE your credit card on file will be billed a minimum of $100 per vehicle infraction.  If damage occurs to the property due to parking illegally your credit card on file will be billed for repairs.

Amenities.   Amenity access is provided to Seabrook Exclusives guests at no additional charge unless noted in the deposit request. All charges accrued by Guest as a result of amenity use, as well as any refunds due to Guest for amenity use, are managed by and the sole responsibility of the Club at Seabrook Island.  The agent is not affiliated with and has no control over Seabrook Island Club, SIPOA, or any amenities.  The agent has no control over, is not responsible for any untimely construction, amenity hours of operation, or amenity closures.  The agent does not guarantee the availability of amenities or area activities (ex. beach, golf, tennis, pools, restaurants, retail stores, etc.).  No refunds or discounts will be offered due to the unavailability of amenities, amenity closures, or unavailability of area activities.

Refunds.  Refunds will not be made due to inclement weather, maintenance or housekeeping issues, issues related to appliances or electronics, unavailability of amenities, unavailability or closure of beaches, or unavailability, closures or limitations on use of other activities (ex. beach, golf, tennis, pools, restaurants, retail stores, etc.).

Pools.  If renting a Property with pool or hot tub access, Guest agrees to release and indemnify Owner and Agent from and against liability for injury to the Guest or any member of Guest’s household or guests of Guest to the Property resulting from use of the pool or hot tub.

Decks and Docks.  If renting a Property with decks or dock access, Guest agrees to release and indemnify Owner and Agent from and against liability for injury to the Guest or any member of Guest’s household or guests of Guest to the Property resulting from use of the decks or docks.

·      IN accordance with SC real estate statutes, reservation deposits are placed in escrow in a federally funded insured state bank.  Any interest accrued on deposits shall belong exclusively to Seabrook Exclusives.

YOU ACKNOWLEDGE, travel insurance is offered to paying guests who rent through Seabrook Exclusives, INC (this does not include rentals made through private parties).  SUN TRIP PRESERVER is the carrier of record for Seabrook Exclusives INC.  YOU AGREE that Seabrook Exclusives INC has no jurisdiction over third party rental insurance carriers.  This cancellation policy is firm. Guests who book through Seabrook Exclusives directly are eligible to purchase travel insurance. Please review travel insurance documents for coverage details.  We strongly encourage you to protect your vacation investment.  You will not be refunded for any cancellation once you are inside the cancellation date for your reservation.

 SUN TRIP PRESERVER Travel Insurance is now partnering with Seabrook Exclusives to offer guest cancellation insurance to our guests. This coverage is voluntary and you are under no obligation to accept this coverage. If you would like to add this protection to your vacation package, please contact our office at 888-718-7949. The cost is 6.95% of the total booking charges. You may purchase insurance anytime before your final payment is made.
